A new points based immigration system focused on the highest skills and the greatest talents will treat EU and non-EU citizens equally and with priority after Brexit.


THE NEW UK POINTS BASED IMMIGRATION SYSTEM COMING INTO FORCE
FROM 1 JANUARY 2021

On 28 January 2020, the Migration Advisory Committee (MAC) published its report to the Home Secretary on a points based immigration system (PBS). The government is currently considering the report’s recommendations before setting out further details on the UK’s future immigration system.

There will be no change to the rights and status of EU citizens currently living in the UK until 30 June 2021

What you should consider when applying for a working visa

Each requirement earns a number of points. The total to qualify for a work visa is 70 points. At the same time, some requirements can be ‘traded’ with others, as long as the total number of points remains at least 70.

Highly skilled workers (without a job offer) can apply for Tier 1 (Global Talent) visa

The Global Talent visa is a re-branding of the Exceptional Talent route and individuals who are endorsed by a relevant and competent body will be eligible to apply.

Skilled Workers (with a job offer) can apply for Tier 2 visa

First of all, Individuals would need to demonstrate that they have a job offer from an approved sponsor. Secondly, thy need to prove that the job is at the appropriate skill level and finally, that they can meet the English language requirement.

Low skilled workers can apply for Tier 3 visa

With free movement ending this year, the current Government’s stance is not to implement a new route for lower-skilled workers. In fact, the Government’s message to businesses is pretty firm; ‘UK businesses will need to adapt and adjust to the end of free movement…

Student Visa Tier 4

The UK Tier 4 category is for adult students aged 16 or over. You may study at or above the National Qualification Framework level 3 under this category. University and college study programs are also included under Tier 4.

It is equally important that there will be no change to the rights and status of EU citizens currently living in the UK until 30 June 2021. EU citizens and their families can apply to the EU Settlement Scheme to continue living in the UK.
